We sell digital data products (contractor contact lists and related datasets). Products are delivered electronically via a download link sent to the email address you provide at checkout. Delivery typically occurs within minutes of purchase.
Your purchase grants you a non-exclusive, non-transferable license to use the data for your own business purposes (marketing, outreach, research). You may not resell, redistribute, or republish the data as a standalone product.
You are solely responsible for ensuring that your use of the data complies with all applicable laws and regulations, including CAN-SPAM, the TCPA, and any state-level marketing regulations. Our data is compiled from public records; we make no representation that any individual contact has consented to receive marketing from you.
Our products are digital files delivered instantly and cannot be returned once downloaded. Because of that, and except as set out below, all sales are final. Buyer's remorse, a change of business plans, and a decision not to use the data are not grounds for a refund.
5.1 Bounce Guarantee. If more than 10% of the email addresses in your file hard-bounce, we will replace every hard-bounced record above that 10% threshold, free of charge, with another licensed contractor from the same county and the same trade. Where a replacement of equivalent scope is not available, we will instead issue account credit equal to that proportion of the purchase price, usable against any other product we sell. This guarantee is satisfied by replacement or credit only; it does not entitle you to a cash refund.
5.2 What counts as a hard bounce. A hard bounce means a permanent delivery failure returned by the receiving mail server — typically an invalid or non-existent recipient, or a domain that no longer resolves. Soft bounces, temporary deferrals, rate limiting, greylisting, spam-folder placement, blocklisting of your sending domain or IP, and messages rejected on the basis of your content or sending reputation are not covered, as these arise from the sender's configuration and practices rather than from the accuracy of the data.
5.3 How to claim. Send the bounce report exported from the sending platform you used, listing the affected addresses together with their bounce codes or status messages, to milton@flcontractordata.net within 30 days of delivery. Screenshots, summaries and unevidenced assertions are not sufficient. We may ask for reasonable additional detail about the send in order to distinguish a data defect from a deliverability problem. Claims made after 30 days, or unsupported by an export, will not be honoured.
5.4 Defective or undelivered files. Separately from the Bounce Guarantee, if your file never arrives, arrives corrupted or unreadable, or contains materially fewer records than the quantity published on the product page at the time of purchase, contact us and we will resend it, correct it, or refund the purchase in full at our election.
5.5 Abuse. The remedies in this section are provided so that you are not exposed on the quality of the data. They are not a trial, an evaluation period, or a means of obtaining the data at no cost. We may decline a claim that is not supported by the evidence described above, and we reserve the right to refuse future sales to any buyer who repeatedly claims under this section.

Data is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Smarts Digital Products LLC's total liability for any claim arising from your use of this website or our products is limited to the amount you paid us.
